Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website dddmaps.com and the DDD Maps service (the "Service"), operated by Sjödin Media ("DDD Maps", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DDD Maps is a tool that generates 3D map animations, including from GPX tracks and other route data that you upload. We offer a free tier and one or more paid subscription plans.

We may add, change, or remove features at any time. We will try to give reasonable notice of material changes that negatively affect paying subscribers.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use a paid plan or enter into these Terms.

Accounts are created and managed through our provider, Outseta. You are responsible for:

  • providing accurate registration information;
  • keeping your login credentials secure; and
  • all activity that occurs under your account.

Notify us promptly at contact@dddmaps.com if you suspect unauthorised use of your account.

3. Free tier and paid plans

Free tier. The free tier is provided at no cost and may include limitations, including a watermark on generated animations and other feature or usage limits. We may change the limits of the free tier at any time.

Paid plans. Paid plans unlock additional features (such as removal of the watermark) as described on our pricing page at the time of purchase.

4. Billing, renewals, and cancellation

Payments are processed through Outseta and its payment processor, Stripe.

  • Pricing and currency are shown at checkout. Prices may be exclusive of applicable taxes (e.g. VAT), which will be added where required.
  • Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price, unless you cancel before the renewal date.
  • Cancellation. You may cancel at any time through your account settings. Cancellation stops future renewals; unless required by law, fees already paid for the current period are non-refundable and you retain access until the end of the paid period.
  • Price changes. We may change subscription prices. Changes apply to the next billing cycle, and we will give you reasonable advance notice.
  • Failed payments. If a payment fails, we may suspend or downgrade your access until payment is resolved.

5. Right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from a distance contract for digital services.

By subscribing and choosing to begin using the Service immediately, you expressly request that we start providing the Service during the withdrawal period and acknowledge that you lose your right of withdrawal once the Service has been fully performed. For digital content/services supplied immediately, the right of withdrawal does not apply once performance has begun with your consent.

This section does not affect any mandatory consumer rights you have under applicable law.

6. Your content

You retain all ownership rights in the GPX files, routes, and other content you upload ("Your Content").

By uploading Your Content, you grant us a limited, non-exclusive licence to host, process, and use it solely to provide the Service to you — for example, to generate the animations you request. We do not claim ownership of Your Content and do not use it for any purpose beyond operating the Service (see our Privacy Policy).

You represent and warrant that you have the necessary rights to upload Your Content and that doing so does not infringe the rights of any third party or violate any law.

7. Output and intellectual property

Your output. Subject to these Terms and to the terms of our third-party providers (see Section 8), you may use the animations you generate ("Output") for your own personal or commercial purposes.

Third-party map data. Output is generated using map data and services from Mapbox and its data sources (including OpenStreetMap). Your use of Output may be subject to Mapbox's terms and attribution requirements. Where attribution is required, you must keep it intact. You are responsible for ensuring your use of Output complies with these third-party terms.

Our IP. The Service itself — including its software, design, branding, and the DDD Maps name and logo — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the right to use it as permitted here.

8. Third-party services

The Service relies on third-party providers, including Outseta (accounts and billing), Stripe (payments), and Mapbox (mapping). Your use of the Service may be subject to those providers' own terms and policies. We are not responsible for the acts or omissions of third-party providers.

9. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • upload content you do not have the right to use, or that infringes others' rights;
  • attempt to reverse-engineer, scrape, overload, disrupt, or gain unauthorised access to the Service;
  • resell, sublicense, or commercially exploit the Service itself (as distinct from your Output) without our written permission; or
  • misuse the Service in a way that harms us, other users, or third parties.

We may suspend or terminate accounts that violate these rules.

10. Service availability

We aim to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. We may perform maintenance or modify the Service from time to time.

11. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy of map data or generated animations.

Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under applicable law.

12. Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill; and
  • our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim (or, if you use only the free tier, a nominal amount).

These limitations do not apply to liability that cannot be limited under applicable law, including liability for intent or gross negligence, or for death or personal injury caused by negligence.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights through Your Content or Output.

14. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you is no longer reasonably viable.

On termination, your right to use the Service ends. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of Norway, without regard to conflict-of-law rules. Disputes shall be subject to the jurisdiction of the Norwegian courts, with Midtre Hålogaland tingrett (rettssted Narvik) as the agreed legal venue.

If you are a consumer, this does not deprive you of the protection of mandatory consumer-law provisions of the country where you reside, and you may also have access to the EU Online Dispute Resolution platform.
